NOTES TO GO WITH AGM CALLING NOTICE

In order that the Association may continue to exist it is vital that a new committee is formed;

This has been a very frustrating year for the members of the present committee.

We did not achieve a quorum at last year's meeting. We were unable to receive I confirmation of appointment.

Your committee agreed to continue in an "acting" capacity for one year only.

The three CMS Ltd. Directors who have been acting as officers of the Association feel that an unfair burden has been placed upon them.

I think that it is time I was relieved of the anxiety that goes with the position.

It is certainly undesirable that CMS Ltd. has a majority voice on your committee. I hasten to add that at all times when decisions are to be made we do our utmost to act as chalet owners and attempt to represent the interests of the majority of GGHHA ] members.

TO PREVENT THE COLLAPSE OF THE ASSOCIATION IT IS THEREFORE ESSENTIAL THAT NAMES OF MEMBERS WILLING TO SERVE AS COMMITTEE MEMBERS ARE PUT FORWARD EITHER BEFORE OR AT AGM.

Constitution & rules

It is proposed that alterations to rules 5, 8i, & 15 are made as follows:-

5.Any member who has not paid his subscriptions or made arrangements to do so by 1st September shall be deemed to have ceased to be a member unless there are extenuating circumstances approved by the committee.

8i. A quorum at a general meeting shall be formed by the presence of at least one officer together with a number of members where that number is greater than the number of officers present.

15. In the event of the winding up of the association the assets of the association shall be divided between the paid up members at the time of the announcement of winding up in proportion to the amount of subscription paid for that year by the member.

Notes on proposed changes

5.Time and money is spent especially in preparations for AGM on members who may have sold their chalet or have no intention of renewing their membership. 6 months leeway should be ample.

8i.Last year we could not carry out normal business for lack of the requisite number. When one or two are gathered together......... Three at least;

15. Members have contributed to the funds so it is only right that member's should say individually where their share of any funds is to go.

GENERAL

Most of our business this year has been carried out via letter or telephone. Meetings are expensive to arrange since committee members live so far apart. Matters raised by members have been few and far between.

I was told that the Jubilee activities on the Park were very good and enjoyed by many owners and holidaymakers.

Terry (of GGE) tells me that many charity events at the Park are supported by the caravan owners but not by the chalet owners. BUT then if we are not told about these events how can we give our support?

My wife and I together with some of our family enjoyed a week's holiday at the park in August.

The park appearance is such that it still gives us as much pleasure to be there as it did 31 years ago when we bought our first chalet. Rain or shine it appeared that the holidaymakers were enjoying their stay.

COSTS RELATING TO CHALET OWNERSHIP

Owners raise this issue from time to time.

I.have spent many hours in correspondence/telephone calls etc. on related matters-

Eg:-

COUNCIL TAX.

In April the demand notice from Gwynedd Council set the charge at between £501 & £503 depending on the area in which the chalet stands- (a council boundary runs through the Park) . With the demand there is a leaflet explaining that no Council Tax is payable for the period of closure. The first batch of chalets to be built has to close during Nov/Dec/Jan/Feb. whereas the later ones close during Jan & Feb.

The first group open for 245 days so only 245/365 is payable i.e. £336.

The second group open for 306 days so only 306/365 is payable £420

The Council claim to discover that you have been charged too much eight or nine months later and then give you a refund saying that circumstances have altered!!!

I maintain that for the privilege of holding on to money for which they have no just claim an amount of interest should be given to the owner.

Since we are talking about a couple of pounds only the Council assume that very few people will bother to raise the matter. As a youngster I often heard the saying, "Look after the pence and ha'pence" the pounds will look after themselves". Of more importance to holders of the early leases is the requirement in the lease to pay a water charge of 15% of the rate payable, which does not amount to £90. by any stretch of imagination.

WATER CHARGE

Several like-minded owners and I have not signed the new water deed and will not do so until the matters which the committee agreed to be a condition of recommending to the members that they sign the deed are implemented.

For my 999yr lease chalet I continue to pay a Water Rate of£17.25p

I have been told by GGE Ltd that they will put the matter in the hands of their solicitor with a view to taking me to arbitration.

I have been told by GGE Ltd that they are taking Counsel's opinion and...

I have been told by GGE Ltd that they have no agreement with me to accept less than £90 water charge.

I have been advised to continue paying £17.25p (My cheque is always accepted)

I have been advised to do nothing until I hear from GGE Ltd.

I have been advised that I do have an agreement to pay less than £90 water rate. My original lease is that agreement.

As an officer ofGGHHA I have suggested that members look at the clause in the new water deed, which refers to payment of less than £90.

No one has come forward to say they want to challenge GGE Ltd to implement this clause and charge everyone the lower rate.

There is a substantial amount in the professional and legal fund to back such a challenge if our solicitor advises that is the right course of action.

MAINTENANCE CHARGE

In your lease and the 1981/2/3 deed of variation there are listed eleven items, which the landlord will provide in return for payment of the Maintenance charge.

1st January I asked GGE Ltd to give some indication of the amount of maintenance charge that went to each of the items. NO REPLY.

I am convinced that some of the items indicate owners are paying twice over for their provision.

ELECTRICITY CHARGE

The regulator sets a maximum charge, which a landlord can levy on a tenant.

In January next the system changes and the landlord may only charge a unit price at the rate paid by him. The standing charge, which he pays, is to be shared equally between all the users.

The regulator says that if a tenant believes he is being overcharged then he must make representations to the landlord or to the courts.

I have been trying since April to find out what standing charge the landlord pays and what will be the unit charge he pays in January.

As a tenant do you think you are being overcharged of from January are you likely to be paying too much for electricity?

How can you find out the facts to prepare a case for presentation to A) the landlord or B) the court?

SITE REDEVELOPMENT CHALET SALE/ RE LOCATION

Planning permission for the siting of the additional 250 static caravans in various areas also included permission to demolish the CONWAY ROSE chalets on the front lawn ofGlan Gwna Hall. They have now gone- grass is growing on the site-

Chalets 32/33/34/35 and Menai 1 & 2 have been demolished and bases for caravans are now being prepared.

A Council Planning Officer tells me that no planning permission is required if a chalet is replaced with a caravan.

Some owners have been approached with an offer to buy the chalet with a simple exchange lease and deeds for cash all expenses and documentation processes to be carried out by GGE Ltd. These chalets are then either:- earmarked for demolition

OR offered as a relocation unit

OR come back on the market with a 25 year lease.

AMENITIES

My wife and I do not normally sample the amenities we are paying for in the site fees. A satisfactory replacement for the boating amenity has not been offered.

I believe some holidaymakers have complained that the amenities have not been up to their expectations.

As owners are you satisfied that you are getting value for money?

As an association these are some of the matters WE should be investigating.

There must be many other matters you would wish to be raised.

Please air your views.

Please offer to relieve the burden on the few who are trying to offer you support.

Please let the next report from the chair have fewer 1111 and more "a member said" and " and a member found out" and "a member did....

In all the dealings that have taken place it has become clearer and clearer that without a strong Association and a competently organised company to carry out its essential requirements for management services and, if need be, lettings. GGE or its successor would be able to dominate and exploit individual owners as they wish.

Your Committee therefore intends to continue to preserve both the Association and CMS and to make this intention clear in all negotiations. However, this positive line can be maintained only with the wholeheacted support of members. Your Committee believes that the warm response to the offer of CMS shares reflects such support.
